Terms of Use

These terms govern your use of this website and the applications published by Fidget Digit Studios L.L.C. ("Fidget Digit Studios", "we", "us"), including BrushMark. By using our website or our apps, you agree to them. If you don't agree, please don't use them.
Who may use our products
You must be old enough to form a binding contract where you live, or have a parent or guardian agree on your behalf. You must be at least 13 years old to use our apps. They are not directed to children under 13, and we do not knowingly collect personal information from anyone under that age.
Your license to use the apps
We grant you a personal, non-exclusive, non-transferable, revocable license to use our applications on devices you own or control, for your own non-commercial use. You may not copy, sell, rent, sublicense, reverse engineer, or attempt to derive the source code of our software, except to the extent that law expressly permits it.
Content you bring in
You keep ownership of any photograph or image you import into our apps. By importing it, you confirm that you own it or have the right to use it. Because the conversion happens entirely on your device, your photograph never reaches us — we receive no copy of it, and you grant us no license to it.
Do not import content that infringes someone else's rights, that depicts a person in a way they have not consented to, or that is unlawful.
Content you create
Pages you color are yours. You may share and print them, including for personal projects.
What you may do beyond that depends on where the picture came from. A painting you make from your own photograph is entirely yours, and we claim no rights over it. A painting you make from one of our illustrations is different, because the underlying artwork stays ours: personal use is free, but commercial use is not permitted without our written permission. That covers selling prints or merchandise, licensing through a stock library, and use in any product, advertisement, or promotion. If you want to use one commercially, write to admin@brushmark.studio and ask.
Our content
The illustrations, artwork, software, trademarks, name, and design of our products belong to Fidget Digit Studios L.L.C. or our licensors, and are protected by copyright and trademark law. Nothing in these terms transfers ownership of them to you.
Purchases
Purchases are sold and processed by Apple under Apple's terms. Pricing, billing, renewal, and cancellation are governed by your Apple Account settings. Refunds are handled by Apple through reportaproblem.apple.com.
Acceptable use
Don't use our products to break the law, to interfere with their operation or security, to scrape or bulk-extract our artwork, or to build a competing product from our assets.
Availability and changes
We may change, suspend, or discontinue any part of our products at any time, including individual features. We will try to give notice of significant changes but are not obliged to.
Disclaimer
Our products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our products will be uninterrupted, timely, secure, or error-free.
Limitation of liability
To the maximum extent permitted by law, Fidget Digit Studios L.L.C. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of our products. Our total liability for any claim relating to our products will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.
Some jurisdictions do not allow these limitations, in which case they apply to you only to the extent permitted.
Apple
Apple is not a party to these terms and has no responsibility for our applications. Apple is, however, a third-party beneficiary of these terms and may enforce them against you. Any claim that an application fails to conform to a warranty may be directed to Apple, who may refund the purchase price; beyond that, Apple has no warranty obligation.
Termination
You may stop using our products at any time by deleting them. We may suspend or end your access if you breach these terms.
Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
Changes to these terms
We may update these terms. The updated version takes effect when posted on this page, and continued use of our products means you accept it.
